Roles and Responsibilities in a Data Governance Program

Data hk is an essential aspect of any modern business. It provides valuable information on customers, competitors and market trends. The PDPO contains some onerous provisions on cross-border transfers of personal data, including a requirement to verify that a lawful basis exists (DPP 1(1)); a requirement to explicitly inform data subjects of the classes of persons to whom their personal data may be transferred (DPP 2(3)); and a requirement to obtain the prescribed consent of data subjects for any change of purpose for which their personal data has been collected (DPP 3). This is in addition to the statutory obligation to comply with the principles of transparency and accountability (DPP 8).

To assist companies with complying with these requirements, the PCPD published a set of recommended model clauses in December 2014. These clauses are intended to be included as contractual provisions in contracts between parties who transfer personal data outside Hong Kong. The clauses are not legally binding, but provide an option for businesses to demonstrate their commitment to compliance with the PDPO by adopting them.

Many data governance programs involve a large number of people. These include employees, partners and customers. It is important to define roles and responsibilities for each person who participates in the program. The program leader, for example, coordinates the activities of all participants and ensures that decisions are communicated. Ideally, they should be an experienced business analyst who can act as a bridge between business and IT.

Another role is the data steward, who reviews and approves data governance processes and policies. They are typically responsible for data quality and are accountable for delivering value from the data governance program to the business. They are the primary point of escalation for any problems that arise. The stewards should have the necessary technical expertise and understanding of the data governance framework to ensure that it is effective.

A final role is the data governance lead, who oversees all aspects of the program and manages the relationships between data stewards and the steering committee and executive sponsor. The data governance lead can also help to ensure that the program remains on track by tracking key metrics. They can also play a critical role in helping the data stewards to understand how their work impacts the organization’s business processes, decisions and interactions. This will allow them to effectively represent the views of the business to the steering committee and executives. They can also assist with establishing and communicating the business case for the data governance program. This is a particularly important role for larger organizations with more complex data governance needs.
